The authors respond to a letter by Mitchell Berger in the March‐April 2024 issue of the Hastings Center Report concerning their essay “Securing the Trustworthiness of the FDA to Build Public Trust in Vaccines.”.

The Covid‐19 pandemic highlighted the need to examine public trust in the U.S. Food and Drug Administration (FDA) vaccine approval process and the role of political influence in the FDA's decisions. Ensuring that the FDA is itself trustworthy is important for justifying public trust in its actions, like vaccine approvals, thereby promoting public health. We propose five conditions of trustworthiness that the FDA should meet when it reviews vaccines, even during emergencies: consistency with rules, proper expert or political decision‐makers, proper (...) decision‐making and noninterference, connection to public preference, and transparency of both reasons and procedures. The five conditions provide a road map of procedural and substantive requirements, which the FDA has variably implemented, focused on ensuring appropriate influence of political interests. While being a trustworthy agency cannot guarantee the public's trust, implementing these conditions builds a groundwork for public trust. (shrink)

Quality improvement mechanisms increasingly use outcome measures to evaluate health care providers. This move toward outcome measures is a radical departure from the traditional focus on process measures. More radical still is the proposal to shift from relatively simple and proximal measures of outcome, such as mortality, to complex outcomes, such as quality of life. While the practical, scientific, and ethical issues associated with the use of outcomes such as mortality and morbidity to compare health care providers have been well (...) rehearsed, the specific concerns associated with the use of quality of life measures in quality of care research have received little attention. As with much research on quality of life there is a tendency to assume that the disadvantages are outweighed by the general virtue of “listening” to patients. In this paper we disagree with this assumption and argue that quality of life is a process, not an outcome. (shrink)

By the time George Wilton Field concluded his work at the marine laboratory his initial scientific concerns had forced him directly into local politics. He pleaded with little success with the community of South Kingstown, and with no success with the town of Narragansett, to create and maintain a permanent breach:Is it not possible for the acute business sense and the broad philanthropy of the community to sweep aside petty, local, and personal jealousies which are now blocking practical progress for (...) the establishment of a permanent breach at Point Judith Pond? It is truly criminal neglect which permits fifteen hundred acres of valuable water-farming area to lie practically idle and rapidly deteriorate with each passing year.... In the opinion of the writer the Point Judith Pond and those of similar type could be made the seat of oyster, clam, crab, herring, white perch, and striped bass fisheries.30In the summer of 1899 Field was invited to teach a summer course on echinoderms at the MBL in Woods Hole, and to conduct summer research in a laboratory of the U.S. Fish Commission, also located at Woods Hole. When the summer was over, he remained there. Whether he had intentions of returning to resume his position in Rhode Island is unclear. At this point all correspondence with the Agricultural Experiment Station ceases, and Field's last report is a brief statement in the annual report of the experiment station for 1900 wherein he laments the variety of experiments he has not been able to carry to conclusion, such as a study of the artificial fertilization of water analogous to the method of chemically fertilizing the land for crops.The correspondence reveals that the enthusiasm Field brought to Point Judith Pond in 1896 was gradually sapped by his own fragile health, by three years' exposure to the local politics surrounding the southern Rhode Island fishing industry, and by a college administration determined to remove the stench of his invertebrates. He sought a refuge in the sheltered world of pure research at the U.S. Fish Commission Laboratory, where he set out to investigate the “Origin of Sex” using, as his animal models, squid and toadfish.On November 14, 1899, the Board of Managers of the college ordered the director of the experiment station to dispose of the marine laboratory at Point Judith Pond.31 How long the laboratory at Buttonwood Point survived in the institutional memory of the University of Rhode Island is open to question. The current Graduate School of Oceanography, in the event, traces its history back to 1937, not 1896.Nevertheless, Field and his one-room marine station established a precedent of land-grant marine research that other state colleges would follow, including Rhode Island itself, which reestablished its marine station, this time permanently, at South Ferry in 1937. In his brief research career in Rhode Island, George Wilton Field had discovered the same coastal attributes that would lead later to the creation of one of the world's major marine research centers at the University of Rhode Island's Graduate School of Oceanography.And, in a measure of triumph for his work, little more than a year after Field left for Woods Hole and his laboratory was dismantled, the town of South Kingstown voted the funds necessary to begin the construction of a permanent breachway.32 Whether Field's scientific reasoning and the conclusions of his marine research played any part in finally deciding the thirty-year-old debate in the affirmative will probably never be known. This paper describes a holistic approach and an interdisciplinary curriculum in enhancing critical thinking and education for democracy at the junior-high schools and highschools levels. The curriculum includes academic subjects such as the humanities, sciences, social sciences and art. The aim of this curriculum is not to teach an additional lesson in history, political sciences, art, etc., but to fostercritical thinking and democratic behavior. The theoretical framework has two bases. Both produced social economies and a political structure of mass democracy. The focal point here is that critical thinking is a prerequisite for the existence of democratic values and principles in a post-modern society. In Matthew 24, Jesus prophesied to his disciples about ‘wars and rumours of wars’ and other eschatological birth-pangs to prepare them in advance on how they are to be responding to eschatological events as they would be unfolding in the interim of his ascension and his promised Parousia. What then does Jesus mean by enlisting ‘wars and rumours of wars’ in this eschatological era to be functioning as ‘the beginning of birth-pangs’ and how should Christians be responding to wars and (...) rumours of wars as eschatological birth-pangs? Employing the redaction exegetical method, this study focuses on interpreting Matthew 24:6−8 to explain what Jesus most probably meant as he enlisted ‘wars and rumours of wars’ as eschatological birth-pangs; and with special reference to the Russia–Ukraine war that broke out on 24 February 2022, recommends from the Olivet prophecy how Christians are to be righteously responding to ‘wars and rumours of wars’ as eschatological birth-pangs. Contribution: This study explored Matthew 24:6−8 to unveil what Jesus means by enlisting wars and rumours of wars as eschatological birth-pangs. With special reference to the Russian military invasion of Ukraine, theological highlights were recommended on how Christians are to be responding to war and war rumours as end-time birth-pains. The variety of basic hoops is precisely the variety generated by all algebras, where * is a continuous t-norm. In this paper we investigate the structure of the (...) variety of basic hoops and some of its subvarieties. In particular we provide a complete description of the finite subdirectly irreducible basic hoops, and we show that the variety of basic hoops is generated as a quasivariety by its finite algebras. We extend these results to Hájek's BL-algebras, and we give an alternative proof of the fact that the variety of BL-algebras is generated by all algebras arising from continuous t-norms on [ 0,1] and their residua. The last part of the paper is devoted to the investigation of the subreducts of BL- algebras, of Gödel algebras and of product algebras. (shrink)

This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

This essay presents a critique of current views of Hugo Grotius which erroneously see him as a major theorist of natural rights and a formative influence upon the rights theory of Thomas Hobbes. Especially singled out for criticism are the misconceptions due to Richard Tuck in a number of writings that discuss the political ideas of Grotius and Hobbes and the relationship between them. In an examination of Hobbes's conception of natural rights, the essay reaffirms its originality and notes its (...) revolutionary potential contrary to the main intention of Hobbes's own political doctrine. Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day. Equipoise is advocated as a means of achieving high scientific and ethical standards in randomised trials. As used in the context of research the word describes a state of uncertainty characterised by the belief that in a trial no arm is known to offer greater harm or benefit than any other arm. Clinicians who lack personal equipoise are advised to accept clinical or communal equipoise, based on current unresolved disagreement among the medical profession. Equipoise is mainly discussed in the literature (...) as an issue for senior doctors and research directors. Limitations of professional equipoise are reviewed, and data on the neglected topic of patients' equipoise are reported using the example of breast cancer trials. In theory, a patient who gives informed and voluntary consent to enter a randomised trial has achieved the equilibrium of equipoise. In practice, equipoise among patients ranges from personal to proxy acceptance. (shrink)

An interrogation of the term 'theory' from the perspective of linguistic discourse Zima offers a new definition of theory from a cultural and sociological perspective, with a view to encountering heterogenerous points of view in critical dialogue.

A questionnaire on the attitudes towards the functions of research ethical committees was sent to members of selected research ethical committees in Wessex and some controls. Almost all respondents felt there was a need for ethical review of research projects; 42 per cent thought there was a need for some training before joining a committee; 67 per cent thought the system could be improved and 47 per cent thought that monitoring or follow-up procedures should be adopted. Ethical committees were thought (...) to be purely advisory, as opposed to mandatory, by 33 per cent, and 63 per cent thought they should restrict their review to ethical problems as opposed to scientific or design problems. Views about the function of non-medical members ranged from 'none at all' to 'very important'. Of the 10 controls who were asked whether they would become a member of an ethical committee if asked, seven said that on balance they would and the reasons stated varied from the view that it was a 'very important committee' to the feeling that it was 'a necessary but irksome job'. The article is concerned with the question of how legal institutions are structured with the use of constitutive, institutive, consequential, and terminative rules. To that end, the regulation of international treaties as laid down in the Vienna Convention on the Law of Treaties of 1969 is analysed. This leads to the discovery of two additional categories of rules: content rules and invalidating rules. Finally, the special status of unique legal institutions is investigated. Unique legal institutions – for example, heads of (...) state, parliaments, and supreme courts – enjoy validity in a legal system to the exclusion of the validity of any other legal institution of the same category in that system.
